This is a legal agreement (all herein and hereafter defined as "Agreement") between you (either an individual or an organization) as an Affiliate and the Manufacturer (either an individual or an organization) identified above, for the Affiliate Program specified above, pertaining any and all computer and server Product / script and associated media, printed materials and electronic documentation (all herein and hereafter collectively defined as "Software").

By buying or having bought more than 1 (one) license of the Software, you agree to be bound by all the terms of the following Agreement and EULA. YOUR RIGHTS AND OBLIGATIONS AS AN AFFILIATE

- provide incorrect / misleading information about our website and products or any other information detrimental to our website and products;

- engage in or sponsor or be affiliated with or endorse or suggest or link to any criminal/obscene/offensive/adult/illegal activities;

TERMINATION

The Affiliate Program will terminate automatically if you fail to comply with the limitations described above. You may also terminate the affiliation by giving the Manufacturer a written notice of termination. The Manufacturer reserves the right to terminate any affiliation that it deems unsuitable without prior notification and has no obligation to provide any reason for doing so.

On termination, you lose your rights as an Affiliate and you lose your accumulated sales. You must also stop promoting the Manufacturer and its products and destroy any affiliation links / articles / any other indication and all of the Manufacturer's materials including trademarked or copyrighted materials in your company / website / emails / publication / printed materials or other means of publication.

DISCLAIMER

This Affiliate Program is provided on an AS IS basis, without warranty of any kind, including without limitation the warranties of merchantability, fitness for a particular purpose and non-infringement.

The entire risk of entering this Affiliate Program is borne by you. Should the Affiliate Program prove erroneous or defective, you agree to indemnify the Manufacturer.

If there is any error/discrepancy in the accumulated sales of the Software, the Manufacturer has the right to decide the correct accumulated sales.

THE MANUFACTURER DOES NOT WARRANT, GUARANTEE, OR MAKE ANY REPRESENTATIONS REGARDING THE USE OF, OR THE RESULTS OF USING, OR THE ACCESSIBILITY OF, OR THE INFORMATION PROVIDED BY, OR ANY DELAYS CAUSED BY THE AFFILIATE PROGRAM IN TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, TIMELINESS, COMPLETENESS, SECURITY OR THAT THE AFFILIATE PROGRAM IS OR WILL BE ERROR-FREE.

THE MANUFACTURER SHALL NOT BE RESPONSIBLE OR LIABLE WITH RESPECT TO ANY SUBJECT MATTER OF THIS AGREEMENT UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER THEORY FOR (I) ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, LOST PROFITS OR LOSS OR INACCURACY OF DATA OR (II) COST OF PROCUREMENT OF SUBSTITUTE GOODS, SERVICES OR TECHNOLOGY OR (III) ANY MATTER BEYOND ITS REASONABLE CONTROL.

The Manufacturer reserves the right to modify any part of this Affiliate Program at any time without prior notification.
